This agreement covers everything published at twotanktrips.com. It is written plainly because a term nobody understands protects nobody.

1. Acceptance

By accessing twotanktrips.com you agree to these terms, to our Privacy Policy, and to the policies linked from the footer of every page. If you do not agree with any part of them, please stop using the site. We may revise these terms; the effective date above will change and continued use after that date is acceptance of the revision.

2. License to use the site

Two Tank Trips grants you a personal, non-exclusive, non-transferable, revocable license to view these pages, to print them for your own use, and to link to them. That license does not include any right to copy the writing wholesale, to republish it, to sell it, to train a commercial model on it, or to create a derivative work from it without written permission. Linking to a page with a normal hyperlink and a fair quotation is always welcome and needs no permission at all.

3. Acceptable use

You agree not to use this site to break the law, to interfere with its operation, or to take things that are not offered. Specifically, and without limiting the general rule, you agree not to: attempt to gain unauthorized access to the server or to any account; introduce malware; run automated scraping at a rate that degrades service for others; harvest email addresses; misrepresent your identity in correspondence; or use the material for scraping itineraries, republishing route descriptions, or passing off our research as your own trip guide.

4. Intellectual property

All text, photography selection and editing, layout, stylesheets, hand-drawn vector artwork, tables and original research on twotanktrips.com are the property of Two Tank Trips or are used under license, and are protected by United States and international copyright law. The name Two Tank Trips and its logo are our marks. Photographs licensed from third parties remain the property of their photographers and are credited in the CREDITS file shipped with this site. Nothing on this page grants you a license to any third-party mark that may appear in a photograph.

This site links to other websites for the reader's convenience. We do not control them, we do not endorse them by linking, and we are not responsible for their content, their accuracy, their privacy practices or their availability. Following an external link is your decision and your risk. Some outbound links are affiliate links, disclosed in the Affiliate and Advertising Disclosure and again on the pages where they appear.

Where liability cannot lawfully be excluded, our total aggregate liability for all claims is limited to one hundred United States dollars ($100). Some states do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Two Tank Trips, its owner and its contributors from any claim, demand, loss, liability or expense, including reasonable attorneys' fees, arising out of your use of the site, your breach of these terms, or your violation of any law or of the rights of a third party.

9. Copyright complaints

If you believe material on this site infringes your copyright, follow the procedure in our DMCA and Copyright Policy, which sets out the notice requirements under 17 U.S.C. §512 and names our designated agent.

10. Termination

We may withdraw or restrict access to the site, in whole or in part, at any time and without notice. Sections 4, 6, 7, 8, 11 and 12 survive any termination.

11. Governing law and venue

These terms and any dispute arising from them are governed by the laws of the State of Missouri, without regard to its conflict of laws rules. You and Two Tank Trips agree that the exclusive venue for any dispute that proceeds in court is the state or federal courts located in Jackson County, Missouri, and both parties consent to personal jurisdiction there.

12. Dispute resolution

Before filing anything, write to [email protected] describing the dispute and what you want. Most things are resolved by an email from a person who can actually fix them. If a dispute is not resolved within sixty days, either party may elect binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Kansas City, Missouri, with judgment on the award entered in any court of competent jurisdiction. Arbitration is on an individual basis: there is no class arbitration and no consolidation of claims. Either party may still bring a qualifying claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property. If you do not want to be bound by this arbitration section, send written notice to the address below within thirty days of first using the site and it will not apply to you; nothing else in these terms changes.

13. Miscellaneous

These terms, with the policies they reference, are the entire agreement between you and Two Tank Trips about this site. If a provision is held unenforceable, it is severed and the rest stands. A failure to enforce a provision is not a waiver of it. You may not assign this agreement; we may assign it to a successor in interest.
